Terms of service

1. Agreement to these terms

These terms are an agreement between you and Formlet, the company that operates the Formlet form and survey builder. They cover your use of the Formlet website, the app, and every form hosted by the service.

By creating an account, or by using the service in any other way, you accept these terms. If you do not accept them, do not use the service.

If you accept these terms on behalf of a company or another organisation, you warrant that you have the authority to bind that organisation, and “you” in these terms means that organisation.

2. Your account

Each login belongs to one human being. Accounts are personal: do not share your credentials, and do not let several people work through a single login — that is what seats are for.

Keep your account details accurate, in particular your email address, because it is how we reach you about billing, security and changes to these terms.

You are responsible for everything that happens under your credentials. If you believe your account has been compromised, tell us straight away and we will help you secure it.

3. Your workspace and your team

A workspace is the home your forms live in. Seats are per person and are not shared between people; the number of seats depends on your plan.

Workspace owners control membership, roles and billing. An owner can invite members, change their roles, and remove them.

Removing a member does not delete the forms they built. Forms belong to the workspace, not to the person who happened to click “create”, so your data stays put when someone leaves the team.

4. Acceptable use

Formlet is a tool for collecting structured data honestly. You must not use it to:

• collect data unlawfully, or collect data you have no right to ask for;
• build phishing forms, or forms that impersonate another person, product or organisation;
• upload malware, or files designed to harm the people who open them;
• collect full payment card numbers in a text field — card details only ever go through the dedicated Payment field, which is handled by our payment processor;
• scrape the service, probe it for vulnerabilities without permission, or interfere with its operation;
• resell Formlet, rebrand it, or present it as your own form builder.

We may remove forms and suspend accounts that break these rules, following section 12.

5. Fair use

Formlet’s promise is that the response count is never gated. This section states plainly what is and is not bounded, so the promise has no fine print hiding inside it.

a. Responses are genuinely unlimited

Every plan, including Free, collects unlimited responses on unlimited forms. Text answers do not count against any quota, and we do not throttle a form for being popular. A form that goes viral on the Free plan keeps collecting.

b. Storage is what is bounded

Files uploaded by respondents count against a per-workspace storage cap: the figures published on the pricing page. Only uploaded files count; text answers never do.

At the cap, new uploads are declined with a clear message to the respondent. Every existing file and every recorded answer remains intact, and the form keeps accepting non-file answers.

c. File size

A single upload may be up to the figures published on the pricing page.

d. Egress and automated access

Exports, embeds and API reads are for normal use of your own data. Sustained automated traffic far beyond ordinary use — continuously re-exporting an entire workspace, or serving Formlet-hosted files as a public CDN — may be rate-limited. We contact you before taking any action, and we never delete data as a fair-use remedy.

6. Your content and your respondents’ data

You own your forms and the submissions they collect. We process that content on your behalf, as your processor, so the service can store, display and export it for you.

For the data your forms collect, you are the controller. That means you are responsible for what you ask people: ask only for what you need, tell respondents why you are asking, and honour their requests to correct or delete their answers.

The privacy policy at /legal/privacy explains how this works in practice, including the rights of people who filled in one of your forms.

7. In-form payments

Payments collected through a Payment field are processed by our payment processor under the processor’s own terms, which you accept when you connect payments.

On the Free plan, Formlet retains a platform commission on each payment collected. On the paid plans, the platform commission is zero.

In every case, on every plan, you still pay the payment processor’s own standard rates. Those rates are set by the processor and are not ours to waive.

You are responsible for tax, refunds and fulfilment on anything you sell through your forms.

8. Plans, billing and renewal

Formlet is offered in the following plans: the figures published on the pricing page.

Paid plans are charged in advance for each billing period and renew automatically until you cancel. Annual plans bill once a year at the annual rate.

Prices are exclusive of taxes. Applicable taxes, such as VAT, may be added to your invoice depending on where you are.

9. Changes, downgrades and cancellation

You can cancel any time, from your billing settings, without contacting anyone. Cancellation takes effect at the end of the current billing period; until then, your plan keeps working as normal.

We do not offer partial-period refunds, except where the law requires one.

When you downgrade, your forms stay published and responses keep arriving. Paid-only features — branding removal, custom domain, partial submissions and deeper results — switch off, and storage above the new plan’s cap becomes read-only. Nothing is deleted because you paid less.

10. Availability and support

We aim for high availability and run the service accordingly, but these plans do not come with a promised uptime figure or a service-level agreement.

Maintenance may cause brief interruptions. We schedule it to minimise impact and, where we can, we announce it in advance.

Support is provided by email. We answer every message, paying customers first.

11. Intellectual property

Formlet’s software, brand, templates and documentation belong to us. These terms give you a licence to use the service while your account is in good standing — nothing more transfers to you.

Your forms and your submissions remain yours, as section 6 states.

If you send us feedback or suggestions, we may use them freely, without owing you anything. That is how a product gets better; we appreciate it.

12. Suspension and termination

We may suspend or terminate an account that breaks these terms, that we are required to cut off by law, or whose use puts other customers or the service at risk. Where practical, we give notice and a chance to fix the problem first.

Clear abuse — phishing, malware, unlawful collection — gets suspended immediately, without notice.

After termination you have a 30-day export window to take your data with you. After that window, we delete what remains, subject to our backup purge cycle.

13. Disclaimers and limitation of liability

To the extent the law allows, the service is provided as-is and as-available, without warranties of any kind, express or implied.

To the extent the law allows, our total liability to you for any claim arising from the service is capped at the fees you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss — lost profits, lost revenue, lost goodwill and the like.

Nothing in these terms limits liability that cannot be limited by law, and nothing reduces any consumer rights you hold that cannot be waived.

14. Changes to these terms, governing law and contact

When we make a material change to these terms, we notify you by email at least 30 days before it takes effect. Continuing to use the service after that point means you accept the new terms; if you do not, you can cancel under section 9 before they apply.

These terms are governed by the laws of Spain, and disputes will be heard in the courts of Madrid, except where mandatory law gives you the courts of your own jurisdiction.
